Terms of Service

Effective date: September 25, 2026. Last updated September 25, 2026.

1.Who we are

photoaicompany ("we", "us", "our") is a Canva-style design studio operated by Aiden Martin, available at photoai.company and through the photoaicompany AI connector. Questions about these terms: support@photoai.company.

2.The service

photoaicompany is a creative-design product: a canvas editor with text and typography tools, stock media, shapes, layers, brand kits, photo filters and adjustments, templates, and design export — including 30 tools available through the AI connector. Paid subscriptions unlock higher tiers as described at purchase.

3.Free tools & AI connector

The photoaicompany AI connector and the design tools are free to use. They contain no cart, no checkout, and no in-app purchases — nothing in them can initiate a charge. Features that require third-party API keys (such as stock search or AI generation) fail honestly when no key is configured instead of producing fake output.

4.Your account

Paid subscriptions require a photoaicompany account. You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account — tell us immediately at support@photoai.company if you suspect unauthorized use.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a subscription.

5.Plans & pricing

photoaicompany is offered in the following tiers:

The features included in each tier are as described on our pricing page and at checkout, which form part of the offer you accept when you subscribe.

6.Billing

Payments are processed by Polar, our Merchant of Record. We do not store full card numbers on our servers.

You are charged the price shown at checkout, in the currency shown there. Applicable taxes are calculated and disclosed at checkout.

Pro and Business subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You may cancel at any time; your subscription runs to the end of the paid period.

Failed payments may result in suspension of paid features until payment succeeds. We will notify you before suspending.

7.Acceptable use

You agree not to misuse the service:

8.Your content

You own your designs, uploads, and brand kits. By using the service you grant us a limited, non-exclusive license to host, process, and display your content solely as needed to operate and improve the service for you. We do not claim ownership of your work, and we do not use it to train AI models.

9.Stock media & AI-generated content

Stock media is provided by Pexels and is subject to the Pexels license terms — check the license before commercial use. AI-generated designs and edits are produced by third-party AI providers; generated output may not be unique and may resemble other outputs. Review AI-generated content before commercial use. We do not guarantee that generated content is free of third-party rights.

10.Our intellectual property

The photoaicompany name, logo, site content, templates we publish, apps, and tools are owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purposes. You may not copy, modify, distribute, or reverse-engineer the service except as permitted by law.

11.Third-party services

The service integrates with third parties: Pexels (stock media), Polar (Merchant of Record for billing), AI providers for generation features, Firebase/Google (identity), Cloudflare (infrastructure), and — when you invoke the connector there — the OpenAI and Anthropic platforms, whose own terms and privacy policies apply. We are not responsible for third-party services we do not control.

12.Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service.

13.Limitation of liability

To the maximum extent permitted by law, photoaicompany's total liability for any claim arising from or related to the service is limited to the amounts you paid to us in the 12 months before the claim arose (or $0 if you used only the free tools). We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities.

Some jurisdictions do not allow certain limitations; where they do not apply, our liability is limited to the greatest extent the law permits.

14.Termination

You may close your account at any time by emailing support@photoai.company; subscriptions run to the end of their paid period. We may suspend or terminate accounts that violate these terms, with notice where practical. On termination, your license to use the service ends; provisions that should survive (intellectual property, disclaimers, liability limits) do survive.

15.Changes to these terms

We may update these terms as the service evolves. Material changes will be posted at this URL with a new "Last updated" date, and for significant changes we will notify account holders by email before they take effect. Continued use of the service after changes take effect constitutes acceptance.

16.Governing law

These terms are governed by the laws of the State of Hawaii, United States of America, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the service will be resolved exclusively in the state or federal courts located in Hawaii, and you consent to the jurisdiction of those courts.

17.Contact

Questions about these terms: support@photoai.company — a human replies to every message.
